BREAST PUMP HIRE TERMS AND CONDITIONS

These terms apply to breast pumps and related equipment hired from Flow & Flourish Limited (“Flow & Flourish”, “we”, “us” or “the Owner”).

The person completing the order or hire agreement is referred to as “you” or “the Hirer”. By completing your order, you confirm that you have read and accepted these terms.

1. Ownership

The breast pump, power supply, carry case and any other reusable equipment provided as part of the hire remain the property of Flow & Flourish Limited. Accessories or parts purchased separately by you become your property and do not need to be returned.

2. Hire period

Your hire begins on the agreed collection or delivery date and continues until the equipment has been returned to Flow & Flourish. The equipment remains on hire, and hire charges continue to apply, until it has been physically returned. Charges still apply if you choose not to use the pump during the hire period.

3. Payment

Hire fees must be paid in advance at the rate shown on the product listing or agreed at the time of hire. Any extension must be arranged and paid for before the current hire period ends. Keeping the equipment beyond the agreed return date does not automatically confirm an extension. If the equipment is not returned when due, further hire charges will continue to accrue at the applicable hire rate until it is returned.

4. Collection and return

You are responsible for collecting and returning the equipment at the place and time agreed with Flow & Flourish. The equipment must be returned with all reusable items supplied with it, including the power supply, cords, adaptors, carry case and any other listed components.

5. Cleaning

The equipment must be returned in a reasonably clean condition. A cleaning fee of $50 may be charged if additional cleaning is required beyond the usual cleaning and disinfection carried out between hires. Single-user milk-contact parts must not be returned unless Flow & Flourish has specifically asked you to do so.

6. Care of the equipment

You agree to take reasonable care of the equipment and protect it from damage, contamination, moisture, excessive heat, pets and unsafe storage. You must not open, alter, repair or modify the equipment yourself. You must tell Flow & Flourish as soon as possible if the equipment is damaged, develops a fault or is not working as expected. If continued use could be unsafe, stop using it until you have received further guidance.

7. Damage, loss or theft

You are responsible for loss, theft or damage occurring while the equipment is in your care, except where the issue results from normal wear and tear, an existing fault or mechanical failure not caused by misuse. If the equipment is damaged, lost or stolen, you may be charged the reasonable cost of assessment, repair or replacement. Flow & Flourish will provide details of the amount being charged. Any theft should also be reported to the Police, and the Police event number supplied to Flow & Flourish.

8. Personal use only

The equipment is hired for use by the Hirer only and must not be lent, sub-hired, sold or given to another person. Any milk-contact accessories purchased for use with the pump are single-user items and should not be shared.

9. Safe use

You agree to use the equipment only for its intended purpose and in accordance with the manufacturer’s instructions and any guidance provided by Flow & Flourish. You are responsible for checking that the pump settings, flange fit and accessories are suitable and comfortable for you. Stop using the equipment and seek advice if pumping causes pain, injury or unexpected symptoms.

10. Travel and removal from the region

The equipment must not be taken outside the region in which it was hired without prior written agreement from Flow & Flourish. The equipment must not be taken outside New Zealand.

11. Changes to contact details

You must promptly tell Flow & Flourish about any change to your address, email address or phone number during the hire period.

12. Faults and mechanical failure

Please contact Flow & Flourish promptly if the equipment develops a fault. You will not be charged for damage caused by normal wear and tear or a mechanical fault that was not caused by misuse, neglect or accidental damage. Where reasonably possible, Flow & Flourish will arrange an assessment, repair or replacement pump. Any rights you have under the Consumer Guarantees Act 1993 continue to apply.

13. No guarantee of feeding outcomes

Breast pumps work differently for different people. Flow & Flourish does not guarantee a particular milk volume, increase in milk supply, level of comfort or feeding outcome from using the equipment. Pump hire and general product guidance do not replace an individual medical or lactation assessment where this is needed.

14. Liability

To the extent permitted by law, Flow & Flourish is not responsible for injury, loss or damage caused by misuse of the equipment, failure to follow the manufacturer’s instructions, use of unsuitable accessories, unauthorised modification or continued use after a fault or safety concern becomes apparent. Nothing in these terms limits or removes any rights or remedies you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or any other applicable New Zealand law.

15. Ending the hire agreement

You may end the hire by returning the equipment in accordance with these terms. Hire fees already paid are not refundable for unused days unless otherwise agreed or required by law. Flow & Flourish may end the agreement and require the equipment to be returned if:

  •  hire fees remain unpaid;
  • the equipment is being misused or is at risk of damage;
  • these terms have been seriously or repeatedly breached; or
  • the equipment needs to be recalled for safety, servicing or repair.

Where practical, Flow & Flourish will give reasonable notice. Immediate return may be required where there is a safety concern or serious breach.

16. Recovery of overdue equipment and payments

Hire can be extended and billed for via invoice. Unreturned equipment within the hired timeframe will be automatically billed weekly until returned. If equipment is not returned or amounts remain unpaid, Flow & Flourish may take reasonable steps to recover the equipment or outstanding balance. You may be responsible for reasonable collection or recovery costs incurred by Flow & Flourish, where permitted by law. You will be notified before the debt is referred to a third-party collection service.

17. Privacy

The information collected through your order or hire agreement will be used to administer the hire, contact you about the equipment, process payments and recover overdue equipment or charges where necessary. Personal information will be handled in accordance with Flow & Flourish’s privacy policy and the Privacy Act 2020.

18. Governing law

These terms are governed by New Zealand law.
